Terms of Service.

The legal terms governing the use of theagency47.com and engagements with theagency47. Written for humans where possible, lawyered where necessary. Last updated 15 May 2026.

1. Scope

These Terms of Service ("Terms") govern (i) your use of the public theagency47.com website ("Site") and (ii) any free interaction with theagency47, including discovery calls and pre-engagement correspondence. Paid client engagements are governed by an engagement contract (Statement of Work) signed by both parties, which supersedes these Terms for the scope of that engagement.

2. About theagency47

theagency47 ("we", "us", "our") is a sole proprietorship operated by Christos Papadimitriou, based in the European Union. Contact: hello@theagency47.com. The Site is operated under these Terms and the Privacy Policy.

3. Acceptable use

You may use the Site for lawful purposes only. You agree not to:

  • Scrape, crawl, or systematically extract content (besides indexed crawlers respecting /robots.txt)
  • Reverse-engineer, decompile, or attempt to derive source code
  • Submit malicious code, run automated load tests, or otherwise attempt to disrupt the Site
  • Use the Site to harvest contact information, impersonate, or harass
  • Misrepresent yourself or your organization in any inquiry or sign-up

4. Free pre-engagement interactions

Discovery calls (typically 30–60 minutes) and AI Audit conversations (€297, one-time) are governed by these Terms, not by a separate engagement contract. Specifically:

  • Confidentiality. Information you share on a discovery call is treated as confidential. We do not redistribute, publish, or sell it.
  • No commitment. Discovery calls and audits do not create an engagement obligation on either side. Either party can decline to proceed.
  • Information for proposal scoping only. Notes from discovery are retained for 90 days for proposal preparation, then deleted unless an engagement is signed (see Privacy Policy §3.3).
  • No professional advice. Anything we say on a discovery call is informational, not contractual. Binding commitments live only in signed engagement contracts.

5. Paid engagements

Paid client engagements (Spark, Workforce Starter, Workforce Pro, Enterprise, retainers, and vertical packs) are governed by a signed engagement contract that specifies scope, deliverables, fees, timelines, intellectual property terms, data processing terms, SLA where applicable, and warranties. These Terms do not override the engagement contract. Common engagement terms include:

  • Money-back guarantee on Workforce Starter and above, exercisable within 14 days of launch if deployed agents do not match the signed specifications.
  • Ownership transfer at handover: prompts, configurations, source files, and integration code are transferred to the client.
  • Data Processing Agreement (DPA) executed before any client data is touched, per Privacy Policy §3.2.
  • Limitation of liability capped at the fees paid by the client to theagency47 in the 12 months preceding the relevant claim, subject to applicable law.

6. Intellectual property

Site content (text, images, code visible in the rendered HTML) is owned by theagency47 unless otherwise marked. You may quote short excerpts with attribution and a link back. You may not republish substantial content without prior written permission.

For paid engagements, intellectual property assignment terms are specified in the engagement contract. The default is full transfer of deliverable IP to the client at handover, with theagency47 retaining the right to discuss methodology and aggregate, anonymized learnings publicly.

7. Third-party links and tools

The Site links to third-party resources (e.g., articles, model providers, integration vendors). We do not control these resources and are not responsible for their content, availability, or terms. Use them subject to their own terms.

8. AI-generated content disclaimer

Content on the Site (guides, blog posts) is researched and written by theagency47. Where AI assistance is used in drafting, all output is reviewed and approved by a human before publication. Specific numerical claims about pricing, market sizes, or productivity gains are cited or marked as estimates. Information is provided in good faith but is not a substitute for professional legal, tax, or business advice.

9. Disclaimers

The Site is provided "as is" without warranty of any kind, express or implied. Without limiting the foregoing: we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components; we do not warrant the accuracy or completeness of information on the Site for any specific purpose; nothing on the Site constitutes a binding commitment by theagency47 except as confirmed in a signed engagement contract.

10. Limitation of liability

To the maximum extent permitted by applicable law, theagency47's total aggregate liability arising from your use of the Site (excluding paid engagements, which are governed by the engagement contract) is limited to €100. Under no circumstances will theagency47 be liable for indirect, incidental, consequential, special, or exemplary damages, or for loss of profits or revenue.

Nothing in this section limits liability for (i) fraud, (ii) gross negligence, (iii) death or personal injury caused by negligence, or (iv) any other liability that cannot be limited under applicable law.

11. Governing law and jurisdiction

These Terms are governed by the laws of the European Union member state in which theagency47 is established (Greece), without regard to conflict-of-laws principles. Disputes arising from or relating to these Terms are subject to the exclusive jurisdiction of the competent courts of that member state. Nothing in this section deprives consumers of mandatory consumer-protection rights in their place of residence.

12. Changes to these Terms

We may update these Terms when our practices change. Material updates are announced via newsletter and shown as a banner on the Site for 30 days after publication. Your continued use of the Site after a material update constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found unenforceable, that provision is severed and the remaining provisions remain in full force.
